Gucci Loses 4 Year Copyright Battle Against Guess

This was only a tiny fraction of the $221 million Gucci were seeking. 

After a 4 year battle, filed by Gucci back in 2009 was overruled by an Italian court in Milan.

Gucci was claiming that Guess copyrighted by using various logos that replicated the Gucci diamond pattern, G Logo and Flora Pattern that Gucci is so well known for on a line of shoes. They claimed the designs infringed on their trademarks and that the designs were ‘unlawful and parasitic free-riding on Gucci’s trademark and brand image’

The Italian court however disregarded Gucci’s claims, stating that the pattern and motifs are very common within the fashion design industry.

Paul Marciano, CEO of Guess commented on the copyright claims stating: ‘The Italian Court in Milan ruled against each and every claim that Gucci filed against Guess 4 years ago. The Tactic of Gucci are nothing less than bullying. Because of their endless resources, Gucci had been forum shopping all over the world to try and stop Guess from expanding its successful accessories business.’ Adding, ‘In my opinion, the 3 year battle in New York and 4 years in Milan was a result of a massive and unnecessary litigation that should have been easily resolved with a simple phone call, which Gucci never made.” Ouch.

Meanwhile, Gucci have confirmed that they will be appealing the decision made.
