Rihanna Wins Her Court Battle Against Topshop

The top featured an image of the star from her We Found Love music video, very similar to the one used on the sleeve of her CV.

Topshop argued that the image licence was bought from a photographer therefore they were well entitled to use it on their products.

Judge Justice Birss, who ruled in Rihanna’s favour, commented on the case saying ‘The mere sale by a trader of a T-shirt bearing an image of a famous person is not, without more, an act of passing off. However, the sale of this image of this person on this garment by this shop in these circumstances is a different matter.”

He further went on to say it was up to Rihanna, to choose which garments the public thought were endorsed by her, not Topshop.
