Christian Louboutin to Appeal Against Court Decision

The red soles were first seen in 1992, after Louboutin saw a shop assistant painting her nails red and applied the colour to the sole of his shoes. He famously said that “Red shoes have great attraction for men.” and so a signature style was created. However, it now seems that Christian Louboutin himself is seeing red.
In April of this year, he filed a law suit against Yves Saint Laurent (YSL) for counterfeiting the red sole design on shoes in their collection. Below you can see the Christian Louboutin red soles on the left and the YSL red soles on the right and they do look pretty similar. The YSL shoes are sold in close proximity to Louboutin shoes in the same stores in America and Louboutin wants this stopped. He is also seeking damages for a minimum of $1 million (£612, 782. 65).

A few days ago the case was dismissed by US Judge Victor Marrero because “… Louboutin is unlikely to be able to prove that its red outsole brand is entitled to trademark protection, even if it has gained enough public recognition in the market to have acquired secondary meaning.” Louboutin is set to appeal against this decision.
